Workers on sick still entitled to holiday pay, Law Lords rule
The House of Lords has ruled that employees are entitled to accrue holiday pay when they are on sick leave. The HMRC v Stringer court case was brought about after a former employee of HM Revenue & Customs (HMRC) requested annual leave when they were on long-term sick leave and was refused. However, the House of Lords finally ruled that employees whose requests for holiday pay during sick leave are denied, can make a claim for unauthorised deduction from wages under the Employment Rights Act 1996.
